- The developmental, psychological, emotional and cultural needs of the child
- The capacity of each person who has, or is proposed to have parental responsibility for the child to provide for the child’s developmental, psychological, emotional and cultural needs
- The benefit to the child of being able to have a relationship with their child’s parents, and other people who are significant to the child, where it is safe to do so, and
- Anything else that is relevant to the particular circumstances of the child. These rules are not one size fits all, but have some capacity to consider benefits, and risks, of each situation.
- Any history of family violence, abuse or neglect of the child, or a person caring for the child (including history of a parent, or parents partner, significant other, which may include a new partner).
- Family violence orders (current and past) that apply to the child, or a member of the child’s family. A child, children, should not be exposed to violence, or the threat of violence.
