We are ex-police, and licensed private investigators, a Gold Coast private investigation firm. We provide a service to business, the private person, and the legal profession. Private investigation, using a licensed private investigator, is legal; the evidence gathered is admissible in court.
We understand the need for evidence, proof, when there is a dispute; you need to prove what you say, to have the evidence to add weight to your position. Where a party is deceiving the court, evidence is required to establish this. It may be direct evidence, such as surveillance, or evidence of surrounding circumstances that tend to prove the fact.
A child custody investigation, a child access investigations, a child welfare investigation, or property settlement support, are family law investigations. For these using an experienced, licensed, private investigator, to investigate, and gather evidence, is a way forward. The truth requires supporting evidence, or supporting circumstances, in court.
A private investigator is the active part of a court case. They can conduct a private investigation, lawfully gathering evidence. A solicitor waits for evidence to be provided to them.
A family law solicitor is there to represent you in court, to represent your interests in negotiation with the opposing solicitor, to present your argument, to contest matters, in court. Private investigators are there to find the evidence you need for court.
For child custody and access the court considers matters including:
- What arrangements would promote the safety (including safety from family violence, abuse, neglect, or other harm) of the child; and each person who has care of the child (whether or not a person has parental responsibility for the child)
- Any views expressed by the child - the court will look at how much children understand and how mature they are; children don’t have to express views if they prefer not to (it not just an age rule, but the maturity of the child, children).
- The developmental, psychological, emotional and cultural needs of the child
- The capacity of each person who has, or is proposed to have parental responsibility for the child to provide for the child’s developmental, psychological, emotional and cultural needs
- The benefit to the child of being able to have a relationship with their child’s parents, and other people who are significant to the child, where it is safe to do so, and
- Anything else that is relevant to the particular circumstances of the child. These rules are not one size fits all, but have some capacity to consider benefits, and risks, of each situation.
- Any history of family violence, abuse or neglect of the child, or a person caring for the child (including history of a parent, or parents partner, significant other, which may include a new partner).
- Family violence orders (current and past) that apply to the child, or a member of the child’s family. A child, children, should not be exposed to violence, or the threat of violence.
The role of the private investigator is that of evidence gatherer, as such we must take cognisance of the stated elements that the court considers. The focus must be breaches of current orders, risks and threats to the children, and the safety of their environment; allegations, without evidence, carry little weight. Where there is a serious, current, threat to a child, or ongoing abuse, this must be reported to the relevant authorities, as the first step.
We conduct family law investigations across the Gold Coast, the hinterland, and the Northern Rivers of NSW. Our investigators are duly licensed.
